Terms of Service

These Terms govern your use of LearnItBy at learnitby.com, which is operated by BDKM LLC ("LearnItBy", "we", "us" or "our"). By creating an account, buying or downloading a product, or selling on LearnItBy, you agree to these Terms. If you do not agree, do not use LearnItBy.

1. Eligibility

You must be at least 13 years old to use LearnItBy. If you are under 18, you may use LearnItBy only with the permission of a parent or guardian, who is responsible for any purchase made on your account. You must be at least 18 years old to sell as a creator.

2. Your account

• You must give a real email address and confirm it before you can log in.
• Keep your password private. You are responsible for activity on your account.
• Tell us at support@learnitby.com if you think someone else has used your account.
• We may suspend or close accounts that break these Terms or put other users at risk.

3. How the marketplace works

LearnItBy is a marketplace where independent creators sell digital learning products such as ebooks, study guides, practice questions, flashcards, mock exams and courses. Creators are responsible for their products. We review creators and products before they appear, but we do not guarantee that any product is complete, accurate or up to date.

Products are meant to help you study and prepare. No product guarantees that you will pass an exam, earn a certification or get a job. Unless a product page says otherwise, creators and LearnItBy are not affiliated with or endorsed by any exam or certification provider.

4. Buying products

• Prices are shown on each product page in the listed currency. Any taxes that apply are shown before you pay.
• Payments are processed by Stripe. We never receive or store your full card number.
• After a purchase or a free claim, the product appears in My library, where you can download its files.
• If a product is later removed from sale, you keep access to what you bought, unless it was removed because it broke the law or someone else's rights.

5. Your licence to use products

When you get a product, you receive a personal, non-exclusive, non-transferable licence to use it for your own learning. You may not share, resell, publish, upload elsewhere or otherwise redistribute products or their files, or share your account so others can download them.

6. Refunds

You may ask for a refund within 14 days of a purchase by emailing support@learnitby.com with your order number and the reason. We will normally approve a refund when

• the files are missing, damaged or cannot be opened, and the creator cannot fix this,
• the product is materially different from its description, or
• you were charged more than once for the same product.

Other requests are reviewed case by case. Approved refunds go back to the original payment method, usually within 5 to 10 business days depending on your bank. A refund removes your access to the product. Free products are not refundable. Nothing in this section limits rights you have under consumer law where you live.

7. Selling as a creator

To sell, you apply as a creator and we approve your application. Each product is reviewed before it is published, and we may decline, return or remove products at our discretion. By applying and by publishing each product, you confirm and agree that

• you own the content or have the rights and permissions to sell and distribute it,
• you grant LearnItBy a worldwide, non-exclusive licence to host, display, promote, sell and deliver the product to buyers for as long as it is offered and to buyers who already have it,
• you are responsible for your content, including any content you created with help from AI tools, and for any claim that it infringes someone else's rights,
• we may remove content and suspend accounts that break these Terms or that we believe infringe someone else's rights, and
• you are responsible for the taxes that apply to your earnings.

We charge a platform fee on each sale, and an estimated payment processing fee may also be deducted. The fees that apply are shown to you before you start selling. Payouts are made through Stripe Connect. By selling on LearnItBy you agree to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service, and you allow us to share information about you and your sales with Stripe.

8. Content that is not allowed

Creators may not upload, and buyers may not request or share,

• exam dumps, leaked exam questions or unauthorised answer keys,
• stolen or pirated courses, or copyrighted testing material used without permission,
• content that is illegal, fraudulent, hateful or harassing, and
• malware or files designed to cause harm.

You also may not scrape LearnItBy, try to get around download limits or access controls, test our systems for weaknesses without permission, or use another person's account.

9. Copyright complaints

If you believe content on LearnItBy infringes your copyright, email support@learnitby.com with a description of your work, the link to the content on LearnItBy, your contact details, a statement that you believe in good faith the use is not authorised, and a statement that the information in your notice is accurate and that you are the owner or authorised to act for the owner. We may remove the content, tell the creator, and suspend creators who repeatedly infringe.

10. Our rights

The LearnItBy name, logo, website and software belong to BDKM LLC. Creators keep ownership of their products, subject to the licences in these Terms.

11. Disclaimers

LearnItBy is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that LearnItBy will always be available or free of errors.

12. Limitation of liability

To the fullest extent the law allows, BDKM LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of LearnItBy. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

13. Indemnity

You agree to indemnify and hold harmless BDKM LLC from claims, losses and costs, including reasonable legal fees, that arise from your content, your use of LearnItBy or your breach of these Terms.

14. Ending your use

You may stop using LearnItBy at any time and ask us to close your account. We may suspend or end your access if you break these Terms. Sections that by their nature should continue, such as licences already granted to buyers, disclaimers and limits of liability, continue after your account ends.

15. Changes to these Terms

We may update these Terms. When we make material changes, we will update the date at the top of this page and, where appropriate, tell you by email. Continuing to use LearnItBy after changes take effect means you accept them.

16. Governing law

These Terms are governed by the laws of the United States, without regard to conflict of law rules. This does not take away consumer protections that apply where you live.
